At the 25th session of the House of Peoples of the Parliamentary Assembly of Bosnia and Herzegovina, held on 29 August 2022, Amendment to the Public Procurement Law was adopted, which was proposed by the Council of Ministers of BiH. Previously, both Houses of the Parliamentary Assembly of Bosnia and Herzegovina adopted the Report of the Joint Committee of both houses of the Parliament on achieving an identical text of this Law. The next step is the publication of the integral text of the Amendment to the Public Procurement Law in the Official Gazette of Bosnia and Herzegovina, which is the responsibility of the experts of the competent authority.
The adoption of the aforementioned law means that Bosnia and Herzegovina has fulfilled one of the key priorities in the process of accession to the European Union. We use the opportunity to thank all the institutions that participated in the process for their contribution.
In order to provide timely information, before the publication in the Official Gazette of BIH of the integral text of the law, in the attachment you can find documents which make up the parts that will represent the integral text of the Amendment to the Public Procurement Law (taken from the website of the competent authority):
- Adopted Draft Law on Amendment to the Public Procurement, no: 01,02-02-1-495/21, 16.03.2021.
- All thirteen adopted amendments to the Draft Law on Amendments to the Public Procurement Law
The adopted bill and amendments together form the integral text of the Amendment to the Public Procurement Law (which will be edited and prepared for publication by the expert service of the competent authority), which will enter into force on the eighth day from the day of its publication in the "Official Gazette of BiH", and will be applied three months after its entry into force, except for the following provision:
- new articles 4a. and 4b. of the Law, which are added by Article 3. of this Law, which apply from the date of accession of Bosnia and Herzegovina to the European Union;
- new paragraphs (5), (6), (7), (8), (9), (10), (11), (12) and (13), which, in accordance with Article 33. of this law, complements Article 75 of the Law, which are applied from the date of entry into force of this law;
Public Procurement Agency, in order to facilitate and simplify application of Law, working on the preparation of an unofficial consolidated version of the Public Procurement Law which will be published through official communication channels, after the official publication of the integral text of the Amendment to the Public Procurement Law in the Official Gazette of BiH.
